According to the legal department of Tekna Technology News, OpenAI issued a statement on Wednesday in X, stating that Elon's relentless actions against the company are merely malicious tactics to slow down OpenAI's progress and seize control of leading innovations in the field of artificial intelligence for her personal gain, and for this reason, it has filed a counterclaim against Elon Musk.

OpenAI’s lawyers argue in the lawsuit that Musk’s ongoing attacks on OpenAI, which recently culminated in a fake takeover bid aimed at disrupting OpenAI’s future, should stop. They argue that Musk should be prevented from further illegal and unfair actions and held accountable for the damages he has already caused.

Musk, who was a member of OpenAI’s original founding team, first filed a lawsuit last spring, saying he wanted to force the company to return to its mission of developing general artificial intelligence for the benefit of humanity rather than seeking profit. Experts have described Musk’s legal case against OpenAI as laughably bad.

Musk withdrew that lawsuit in June, but sued OpenAI again in August. In December, OpenAI published a blog post titled Elon Musk Wants a For-Profit OpenAI, along with the documents. The case is scheduled to go to trial in the spring of 2026.

Elon Musk also made a $97.4 billion offer to buy OpenAI earlier this year, saying in a statement that it was time for OpenAI to return to the open-source, safety-focused force for good it once was. OpenAI’s board of directors unanimously rejected the offer, which was called a sham in today’s filing.
